Rules & Regulations of Riding
- You
must be over 107 cm (42”) to bodyboard on the FLOWRIDER
- You must be over 134 cm (52”) to ride stand up on
the FLOWRIDER
- You must be over 8 years old to participate in this activity
Do not go on the FLOWRIDER® if you are under any of the
following:
- Recent accident, injury or a current medical
condition such as heart problems, high blood pressure, aneurysms, neck or
back problems.
- Under the influence of drugs or alcohol.
- You must be able to swim in fast moving water.
- You must follow the guidelines of proper
attire to ride the FLOWRIDER®. Riders are required to wear wetsuits. NO bikinis or casual wear such as jeans, nor any
other outfit with buttons and zips are allowed.
FLOWRIDER® Cornwall House Rules
- Every rider must register and fully complete
the Indemnity forms before Riding the FLOWRIDER®.
- Please arrive at least 20 minutes before your ride
time.
- All payments must be made before every session
on the FLOWRIDER®
- You are to be responsible for the good care of
your belongings. FLOWRIDER® Cornwall is not responsible
for any losses or stolen property.
- All sessions INCLUDE the safety brief &
board instructions.
- Proceed to the FLOWRIDER® for
check-in and safety briefing by the FLOWRIDER® Cornwall
instructor on the hour.
- There is strictly NO SMOKING within the
FLOWRIDER® Cornwall area.
- FLOWRIDER® Cornwall will
manage the opening of the waves according to capacity and at its sole
discretion.
- Please be aware that our Flowrider is NOT
heated. Therefore temperatures will fluctuate throughout the year.
Disclaimer
I, the party leader, am using Retallack Watersports
at my own risk. Which I also agree to inform my other party members of this. We
voluntarily assume in consideration of the fee paid by us, and in full
recognition of the risks involved with such equipment and structure, We
voluntarily assume these risks and we agree with Retallack Watersports and
their employees and directors to hold them harmless from any and all liability,
claims, damages, actions, and causes of action whatsoever, for loss, damage, or
injury to persons, including death, and whether sustained by myself, my spouse,
my parents, my child or children, or property, regardless of how arising and
however caused. This is including but not limited to all kinds and degrees or
extent of negligence, (except willful or misconduct) which Retallack
Watersports and/or its employees may commit or be charged with whether
consisting of omission or commission, whether separately or concurrently with
someone else, and sustained by me, or us, my spouse, my parents, my child or
children, in connection, directly or indirectly, with the use of the
recreational equipment. This release shall be binding upon me, my heirs, next
of kin, and legal representative.
I further agree that I am personally liable and
responsible for paying any claims which may arise as a result of the use of
Retallack Watersports, including, but not limited to any claims for personal
injury, any claims for property damage to any equipment or to other property,
any claims for loss of equipment or loss of use of any equipment, any claims
for diminution in value of any equipment, any claims for the cost to repairing
or replacing any equipment or any other claims of any kind or nature which may
arise from the use of any equipment while in my possession. I further authorise
Retallack Watersports to bill any such charges or cost to my credit card or to
my account as Retallack Watersports deems appropriate.
I acknowledge Retallack Watersports are in guided,
and I will participate in a mandatory safety briefing session prior to the
start of the session. Should I prove unwilling or unable to follow the safety
rules while undertaking a Retallack Watersports session, I acknowledge that
Retallack Watersports has the right to and may immediately end my session and
have me leave the premises.
I acknowledge that I am required to wear an
approved flotation device while participating on the aqua Park, Wake Park & Sups. I am aware that lifeguards or instructors are available to answer
any questions that I may have as to proper use of the equipment. I am aware
that the physical exertion required of Retallack Watersports and the forces
exerted on the body can activate or aggravate pre-existing physical injuries,
conditions, or congenital defects. I acknowledge that the level of
participation is always completely up to the individual.
I am aware that no refunds will be given 48 hours
prior to the sessions for Retallack Watersports, including passes for future
use of the course. Drug or Alcohol consumption prior to, and/or during sessions
are strictly prohibited. Anyone deemed under the influence will not be able to
partake in the activity.
I understand that as part of my participation in
this event my photograph may be taken by a representative of Retallack
Watersports or any media that me be present and that my photograph may be used
in promotional advertising or media coverage. This constitutes my authorisation
to use my image for such purpose.
· Each
guest or guardian for children under 18 years of age must agree to the
Retallack Watersports release of liability form before starting the activity.
· Guest
must always wear flotation device and keep it buckled and zipped for Aqua Park,
Wake Park & Sups.
· Sharp
objects such as jewellery, glasses, watches, hair pins, or other dangerous
materials are not permitted
· NO
refunds will be granted 48 hours prior to session
· NO
drugs or alcohol are to be consumed prior or during Retallack Watersports
session, anyone deemed under the influence may not participate in the activity
· Pregnant
women are prohibited from taking part in Retallack Watersports
· Retallack
Watersports reserves the right to close the activities without refund at any
time due to inclement weather deemed unsafe for guest
